Terms of Service

These Terms of Service govern your access to and use of Stream Sync Engage, a product of Mach Five Tech (Arcanus 55). By creating an account or using Stream Sync Engage, you agree to these Terms.

Eligibility

You must be at least 13 years old to use Stream Sync Engage. If you are using Stream Sync Engage on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at hello@streamsyncengage.com if you suspect unauthorized use.

Acceptable use

You agree not to use Stream Sync Engage to:

• Violate any applicable law or third party right
• Send unlawful, harassing, deceptive, or harmful content to your users
• Attempt to gain unauthorized access to Stream Sync Engage, other accounts, or our infrastructure
• Reverse engineer, decompile, or otherwise attempt to derive source code except where expressly permitted by law
• Interfere with or disrupt the integrity or performance of the service
• Use Stream Sync Engage to build a competing product

We may suspend or terminate accounts that violate these rules.

Your content

You retain ownership of the content, messages, surveys, and other materials you create or upload to Stream Sync Engage. You grant us a limited, worldwide license to host, store, transmit, and display your content solely to operate Stream Sync Engage and provide it to you.

You are solely responsible for your content and for ensuring you have the rights to use it.

Our intellectual property

Stream Sync Engage, including its software, design, documentation, and brand assets, is owned by Mach Five Tech and is protected by intellectual property laws. These Terms do not grant you any right to our trademarks, logos, or trade dress except as needed to use Stream Sync Engage.

Paid plans and billing

If you subscribe to a paid plan, you agree to pay the fees described at the time of purchase. Subscriptions renew automatically until canceled. You can cancel at any time through your account. Fees are non refundable except as required by law.

We may change pricing with reasonable advance notice. Changes will not apply to your current billing cycle.

Service availability

We work to keep Stream Sync Engage available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice.

Termination

You may stop using Stream Sync Engage at any time by closing your account. We may suspend or terminate your access if you violate these Terms or use Stream Sync Engage in a way that creates risk for us or other users.

Upon termination, sections of these Terms that by their nature should survive will continue to apply (including ownership, disclaimers, liability limits, and dispute provisions).

Disclaimers

Stream Sync Engage is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement.

Limitation of liability

To the maximum extent permitted by law, Mach Five Tech and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of Stream Sync Engage.

Our total liability for any claim arising out of these Terms or your use of Stream Sync Engage will not exceed the amount you paid us in the twelve months preceding the claim, or one hundred U.S. dollars, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Mach Five Tech, its affiliates, and their personnel from any claim arising out of your content, your violation of these Terms, or your violation of any law or third party right.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the date at the top of this page. Material changes will be communicated through Stream Sync Engage or by email. Continued use after changes take effect constitutes acceptance.

Governing law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law principles. Any dispute will be resolved in the state or federal courts located in Lake County, Illinois.
